These Terms & Conditions (“Terms”) govern your access to and use of The Nursery’s website (https://www.thenursery.sg/) (“Site”) and your purchase of products or services from the Site (collectively, “Services”, “Products”, “We / Us / Our / The Nursery”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you should not use the Site or place orders.
1. General
1.1 We reserve the right to amend or vary these Terms at any time without prior notice. The version posted on the Site at the time you place an order shall apply.
1.2 These Terms are to be read together with any additional terms, policies or disclaimers which we explicitly reference (e.g. Shipping & Returns, Privacy Policy, Warranty). In case of conflict, the more specific policy prevails.
1.3 All prices on the Site are quoted in Singapore Dollars (SGD or “S$”) and are inclusive of Goods & Services Tax (GST), unless otherwise stated. The Nursery’s GST registration number is 202033173H (as published on the Site). thenursery.sg
2. Eligibility, Account & Registration
2.1 You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register an account or place an order.
2.2 When you register, you agree to provide true, accurate, current and complete information. You are responsible for keeping your account credentials secure, and for all activity under your account.
2.3 We may suspend or terminate your account if you breach these Terms or engage in prohibited conduct.
3. Orders, Payment & Pricing
3.1 All orders are subject to acceptance by The Nursery, which we reserve the right to refuse for any reason (e.g. stock unavailability, pricing errors, suspected fraud).
3.2 You must pay all applicable charges for the Products you order, including the product price, shipping, handling, taxes, and any other fees. We accept payment methods as displayed at checkout.
3.3 Risk of loss and title to Products pass to you upon our delivery (or transfer to the courier) to your designated address.
3.4 We may change product prices, promotions or availability without notice. However, once you place an order (and we accept it), the price is fixed unless there is an error or fraud.
4. Shipping, Delivery & Returns
4.1 Shipping & Delivery
- We deliver only within Singapore (unless otherwise stated).
- Delivery timelines are estimates only. We are not liable for delays caused by third-party couriers, force majeure, customs hold-ups, or other events outside our control.
- You must provide accurate delivery address and contact details. We may charge you for re-delivery or address correction.
4.2 Returns, Refunds & Exchanges
- Our Site includes a “Shipping & Returns” policy (linkable) that outlines eligibility, process, timelines, and conditions for returns, refunds or exchanges.
- You should inspect items upon delivery and report defects, damages or missing parts within the timeframe set in our returns policy.
- Products returned must generally be in original condition and packaging, unless defective.
4.3 Final Sale Items
Some items may be marked as “final sale” and are not returnable or exchangeable, unless defective or damaged.
5. Use of the Site, Prohibited Conduct & Intellectual Property
5.1 You may use the Site for lawful purposes only. You may not:
- upload or transmit content that is unlawful, defamatory, infringing, obscene, harassing, or otherwise objectionable;
- interfere with or disrupt the Site’s operation, or attempt to gain unauthorized access;

- infringe any intellectual property rights (copyright, trademark, patents) of The Nursery or third parties.
5.2 All content on the Site (including text, images, designs, logos, graphics) is the intellectual property of The Nursery or its licensors. You may not reproduce, distribute, modify, or create derivative works without prior written permission.
6. Warranties, Disclaimers & Limitation of Liability
6.1 Where required by Singapore law (e.g. the Consumer Protection (Fair Trading) Act), implied warranties cannot be excluded. However, subject to such statutory rights, all Products are provided “as is” and “as available” without further warranties (express or implied).
6.2 To the maximum extent permitted under applicable law, The Nursery and its affiliates, employees, agents, or suppliers shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from use of the Site, Products, or Services, whether in contract, tort or otherwise.
6.3 Our total aggregate liability for any claim under or in connection with these Terms or your use of the Site or Products shall be capped at the total amount you have paid to us in respect of the relevant order.
7. Force Majeure
We shall not be liable for any failure or delay in performing obligations under these Terms where such failure or delay is due to events beyond our reasonable control (e.g. natural disasters, strikes, acts of government, pandemics, transportation failures).
8. Indemnification
You agree to indemnify, defend, and hold harmless The Nursery (and its officers, directors, employees, agents) from and against any claims, damages, losses, liabilities, costs or expenses (including legal fees) arising out of:
- your breach of these Terms;
- your use of the Site or Products;
- your violation of rights of third parties.

12.1 These Terms are governed by the laws of Singapore.
12.2 Any dispute, controversy or claim arising out of or relating to these Terms or your use of the Site shall be referred to and finally resolved by arbitration in Singapore or in the Singapore courts (as you and we may agree).
12.3 You agree to submit to the non-exclusive jurisdiction of the courts of Singapore for all proceedings.
